Who can legally work in Australia?

In Australia, you can legally work if you are:

  • An Australian or New Zealand citizen.
  • An Australian permanent resident.
  • Have the right Visa.

Please note, Australian visas can have restrictions including only being able to work for a certain employer or a specific number of hours.

Note: Foreign nationals who don’t have a valid visa are not allowed to work in Australia. This can include a person whose visa has expired or been cancelled.

You can either bundle the right-to-work check check alongside a police check, or you can process your right-to-work checks “standalone” without needing a corresponding Nationally Coordinated Criminal History Check.

This flexibility allows your to easily re-check and monitor candidates without needing a full police check each time. For foreign workers, it’s important to always re-check your candidates on a regular basis, in case of any changes to their visa term or conditions.

Who is Elite Screening Australia?

Elite Screening Australia is an Australian Criminal Intelligence Commission (ACIC) accredited agency. Our systems are connected to the department of immigration’s Visa Entitlement, so you can quickly obtain accredited NCCHC, right to work checks.

Do work visa entitlement checks use the VEVO database?

We connect to the department of home affairs VEVO system to confirm work visa entitlement status with the exception of New Zealand citizens.

For NZ citizens we are able to verify the validity of their citizenship via our access to global databases. NZ residents may still need to confirm work rights in Australia. Please note, only registered Australian companies can obtain a standalone VEVO check.

Why is a work visa entitlement check important?

Temporary Visas can sometimes be cancelled. Or, before the original visa has expired a visa holder may apply for a substantive visa.
